Although this site is accessible worldwide, not all products or services discussed or referenced herein are available to all persons or in all geographic locations. We reserve the right to limit or alter, at our sole discretion and without limitation, all aspects of service(s) rendered, to include but not to be limited to, the provision and quantity of any product or service to any person or geographic area. Any offer for any product or service made in or through this site is void where prohibited.

Refunds

Refunds are available only in the event that the purchased activity can no longer be offered in any form. If approved, all refunds will be issued to the purchaser of the reservation or gift certificate. We may also be required to uphold pre-existing vendor policies, which may include, but are not limited to, additional penalties or forfeitures. Reservations cancelled prior to 72 hours from the corresponding date and time of service may be rescheduled for 2 years from the date of original purchase.

Events may be cancelled by the service provider for various reasons which may include, but are not limited to, inclement weather, equipment maintenance, emergencies, or other unforeseen circumstances. In the event of inclement weather, most vendors will reschedule the experience if they are forced to cancel. Regardless of individual vendor policies, we will attempt to find a service provider able to fulfill your purchase.

To request a refund, contact our customer service department containing the certificate or reservation number, purchaser name, address, telephone number and all information pertaining to the request. Expect a response within (10) business days.
Agents are available to accept your phone calls seven (7) days a week at our Corporate Headquarters. Hours of operation may vary seasonally, but agents are generally available during times convenient for customers located in regions stretching from the East Coast to the West Coast.

Service Providers

We have Service Providers nationwide and we are continuously adding locations and services offered. In the event that we choose to alter or withdraw Service Providers, comparable alternatives will be offered. In such cases, recipients will be able to exchange their purchase for a different Experience of the same monetary value. In order to participate in the experience, participants will be required to accept our Service Providers’ Terms and Conditions, which may be different from our own. Participants may also be required to sign an acceptance form or a waiver by the Service Provider and will be informed of this when they redeem their Certificate or by the Service Provider at the time of their Experience.

Information & Promotional Material

We strive to keep all information regarding the Experiences as accurate and up-to-date as possible. However, precise details of each Experience may change from time to time and from Provider to Provider. The Experiences and information described and provided within promotional materials and websites are subject to change without notice. The pictures used to display experiences, in all promotional material and websites, are for illustrative purposes only and may not accurately reflect the details of an individual Experience. The duration of each Experience is an approximation under ideal circumstances. Details regarding the number of participants, wait time, facilities, faculty, and other location specific experiences solely depend on the operations, policies, and procedures of each Service Provider, all of which are outside of our control. We will provide itineraries and other relevant information as a guide whenever possible.

Experience Requirements

It is the responsibility of the participant to comply with all necessary requirements of the Experience as set by us or any enacted Service Provider. Experiences may be restricted by factors that may affect safety, including, but not limited to, age, health, physical ability, height, and weight.

Descriptions will, as accurately as possible, explain the limitations or requirements relating to each Experience. Participants may be liable for costs from cancellations due to such restrictions. Full details of all restrictions for each Experience may be obtained by contacting our Customer Service department.

Gift Certificates

Gift Certificates are valid for specific Experiences as they are indicated upon each certficate and may be exchanged for other experiences of equivalent value prior to booking. We reserve the right to impose administrative fees in such cases. The new Experience will have the same expiration and redemption dates as the original Gift Certificate. The Gift Certificate is proof of payment. The Certificate Number and Redemption Reference found on the Gift Certificate will be used to identify acceptable recipients when contact is made with us. Gift Certificates are non-replaceable and must be presented and intact on the day of the Experience. Gift Certificates can be redeemed for service from the Issue Date. Gift Certificates are valid until the Expiration Date printed on the back of the Gift Certificate or until service is made on the Redemption Date, whichever is sooner. Availability

Experiences should be booked a minimum of 14 days in advance and further for weekends or holiday periods. Selective Experiences and Service Providers may be seasonal, and certain popular times such as holidays, that may become unavailable earlier than others. To increase the likelihood that your preferred date and time will be available, it is suggested that you call at least a month in advance if you would like to secure an event for a special occasion or holiday.

While we strive to meet your needs, we cannot guarantee that we will be able to provide an Experience on a chosen day. Participants will receive a receipt by email of their Experience. Please do not make any travel or other related arrangement until the booking has been confirmed.

We reserve the right to substitute certain elements of the Experience, should those elements become unavailable due to circumstances beyond our control. We reserve the right to cancel an Adventure Experience based on the availability of our Service Provider(s). In this event, a Customer Service Representative will attempt to contact you, and, only in the context of Service Provider availability, your activity will be rescheduled at a time of your choosing.

Cancellations

If you are unable to make your appointment for any reason, you must contact us prior to 72 hours before your scheduled appointment. You must provide the certificate or reservation number and any relevant purchaser information along with the date and time of the appointment. This entitles you to reschedule your appointment or transfer the credit to another service or location. If you do not send notice of your cancellation request according to our set guidelines, you forfeit the value of the certificate and reservation. In such cases, the appointment cannot be rescheduled.

Your Right To Privacy

If you wish to purchase products or services described in this site, you may be asked to supply certain information, including credit card or other payment information. By providing such information, you represent and warrant that it is accurate, complete, and current. By making any such purchase, you agree to pay all charges (including shipping and handling charges) incurred by users of your credit card or other payment mechanism at the prices in effect when such charges are incurred. You are responsible for paying any taxes applicable to such a purchase. Data about the activity of visitors to this site is automatically provided to us. We may use or disclose information about your demographics and use of the site in any manner that does not reveal your identity. Email addresses, postal addresses, or telephone numbers and other personally identifying data about you is known to us only when voluntarily submitted or posted to this site. We may use such personally identifying information, as provided by you, to communicate with you regarding Experiences. We may also use this information to communicate advance notice of events and new products and services. We reserve the right to refuse any order for any reason. Orders may be delayed or canceled if we are not given completely accurate information and/or are unable to contact the person who has placed the order or the primary cardholder.
Equality

We recognize that persons with disabilities may have difficulty participating in certain Experiences. We encourage the involvement of all persons in our Experiences. To help us meet your needs, we ask that you inform us of any related disability when the Experience is ordered. Other Terms & Conditions

We are independently owned and operated. Each Service Provider is individually responsible for their health and safety standards and operating practices. We make no guarantees of the consistency, efficacy, or safety of individual Service Providers.

We accept no responsibility and shall not be liable for any loss, injury, claim, cost, damage, or any special, exemplary, punitive, indirect, incidental, or consequential damages of any kind, whether based in contract, tort, strict liability or otherwise arising out of, or in anyway connected with: (a) the use and redemption of this certificate or (b) the performance or nonperformance by any Service Providers ,even if all parties have been advised of the possibility of damages. We shall under no circumstances be liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces or causes beyond our reasonable control.

By exchanging the Certificate or ticket, the participant accepts all Terms and Conditions stated at the time of service and releases us from any and all liability for any loss, injury, claim, cost or damage directly or indirectly connected with the chosen Experience.

If any provision of this Agreement is found to be invalid or unenforceable in any respect, the validity and enforceability of the remaining provisions shall remain unaffected. All clerical errors are subject to correction. The failure for us to enforce, at any time, any of the provisions of the Agreement shall not be construed to be a waiver of any provisions or the right of us to enforce such provisions in the future. Purchaser may not assign any rights under this Agreement without the written consent. Purchaser shall have no right to set off amounts due with respect to one transaction for claims under any other transaction with us.

Any disputes arising under this Agreement shall be resolved, if not sooner settled, by a state or federal court of competent jurisdiction located in Georgia, U.S.A., and the Purchaser hereby irrevocably submits to the exclusive jurisdiction of such courts. These Terms and Conditions are subject to change without notice.

DEFINITIONS

Purchaser

The person who completes the financial transaction with us. An electronic receipt will be provided to the purchaser at the time of the transaction.

Service Provider

Any corporation, individual, or group of individuals, designated by us engaged in the provision of Experiences or related materials.

Recipient

The person or persons designated to participate in the Experience by the purchaser.

Participant

The person who participates in the Experience.
